UPSHUR COUNTY - While WV House Bill 4535 repealed the section of WV Law §18-8-11 relating to school attendance and satisfactory academic progress as conditions of licensing for the privilege of operation of a motor vehicle PRIOR to obtaining a permit or license through the proof of enrollment process, the bill enacted measures following licensure.
As of June 9, 2022, school districts are required to (shall) monitor students with a license or permit and report to the DMV.
Students who have excessive absences (15 or more unexcused absences or 10 consecutive unexcused absences), fail to remain appropriately enrolled in school (either willingly or unwillingly), have certain serious disciplinary issues, and/or who are not making academic progress toward graduation (have an F in any class required for graduation) are required to be reported to the Department of Motor Vehicles (DMV) for restriction or suspension of their license.
Notice will be sent to parents and students by a certified letter from the DMV should this action be taken, per WV HB 4535. An appeal process is available.
